An estate probate is the legal process of administering a deceased individual's estate by resolving all claims and delivering all property according to the underlying will. An estate probate is the tangible action of dispensing the deceased individual's property and the assets attached to the property to that person's designated inheritors.

An estate probate is administered by a surrogate court. The court decides the validity of the will and then initiates the probate when the individual passes away. A probate interprets the instructions of the deceased’s will and imitates the intended action of the deceased individual.
